The first part of that statement is without question - the bulk of the money comes from YC. The second part could be argued. Under the 106 agreement, the trigger point has not yet been reached, therefore no-one has broken any commitment. The way NewCold was put through maybe suggests that that is what will happen, but we haven't got there yet!

What is to stop another Newcold-type development appearing around the site that doesn't count towards the trigger point? Surely the precident has been set now. And anyway, what trigger point? The 106 agreement doesn't seem to be worth the paper it is written on. Without the threat of legal reprisals i can't see YC ever paying up.

So where is the land the club may have acquired from the council? How much will the BOI want to buy BV? Has the Super Bowl been sold from under our feet? Might send these questions to the Guardian, they seem to know more than MC.

I'm not 'on call' to answer every question raised, but:



The trigger point is 60,000 sq ft.

The developer can apply under whatever guise he wants - the council are not obliged to accept it.

Legal reprisals - last resort, but under discussion.

Didn't expect you to be on call! My point was if the 106 is as useless as it seems does the trigger point actually exist anyway? And if the agreement is not legally binding then would we actually have any recourse for legal action? YC seem pretty slippery and appear to be holding all the cards here despite them being in the wrong. It stinks.

Our opinion is that the 106 itself maybe flawed, but its the execution, or not, of it which is the real issue.

Ive said time and time again Box is a cas season ticket holder why would he try his hardest pushing his rivals through. I wouldn't if I was trying desperate to build a cas ground. Such a shame

. On + side now Cas have got theres passed he may try for ours now as his nearest and dearest have nothing to lose.

When will it be decided which way we are going and if not when can we start kicking off about the way this has been handled by York court and the council.

Do the Trust, or the club, have a specialist planning lawyer advising them on this? If not, now might be the time - not cheap, but in my experience, worth the money.
